Zur Zeit geistern viele gegensätzliche Meldungen über die Legalität von elektronischen Zigaretten durch die Medien und verunsichern die Verbraucher:

Die Erfolgsgeschichte der E-Zigaretten könnte ein jähes Ende finden, denn die Bundesregierung hat nikontinhaltige elektrischen Zigaretten als zulassungspflichtige Arznei eingestuft. Der Verkauf des nikotinhaltigen Liquids, dass in den E-Zigaretten verdampft wird, ohne entsprechende Zulassung wäre demnach illegal.

Viele Raucher steigen zurzeit aufs Dampfen um: Statt der herkömmlichen teerhaltigen Glimmstängel greifen sie zu E-Zigaretten. Doch rechtlich ist deren Vertrieb noch eine Grauzone. Nun hat sich die Bundesregierung zu dem Thema geäußert – und mitgeteilt, dass sie die neuen Produkte als zulassungspflichtige Arzneimittel betrachtet, sofern diese Niktoin enthalten. Ohne diese Zulassung sind Verkauf und Handel der nikotinhaltigen Liquids verboten. Das geht aus einer Antwort der Bundesregierung auf eine Kleine Anfrage der Linksfraktion hervor.

Handel ist nicht verboten
Die jüngste Stellungnahme des Bundesministeriums für Gesundheit ist die Antwort auf eine Anfrage der Linksfraktion im Bundestag. Es handelt sich hierbei nicht um eine offizielle Regierungserklärung zur eZigarette, zumal wesentliche Punkte der Anfrage nicht beantwortet werden konnten.Daher ist der Handel und Gebrauch der eZigarette auch weiterhin nicht verboten! Der VdeH bestärkt alle Händler und Konsumenten darin, sich nicht weiter verunsichern zu lassen.
Ich habe mir heute mal selbst die Mühe gemacht und habe meinen üblichen Tabakladen besucht. Dort habe ich nach e-Zigaretten und Liquid gefragt. Beides ist nach wie vor in Frankfurt am Main im Handel frei erhältlich und kann problemlos erworben werden.
Viel Rauch um nichts und wieder mal ein Versuch der Tabakindustrie und -Lobby den stärksten Konkurrent im Milliardengeschäft mit Zigaretten und Tabakprodukten los zu werden ?

Apparently drugs firms – the manufacturers of
smoking cessation aids are putting their money behind an anti e-cig smear campaign – not so much the tobacco firms (as you might presume) – as these cigarette companies
are investing in them. I can FEEL the benefits of
electronic cigarettes. Just complaining – that there is always some reason with these faceless entities trying to stop e cigs .
.. the authorities could do a lot more to support them.

I really hope they don’t ban e-cigarettes. I have not had a tobacco cigarette for three months now due to using e cigarettes. I am a devoted fan of e-vapes. I tell everyone I meet to just search on Google for for e-cigs to see how well rooted this industry is, and how large the market is for these wonderful products is. What really annoys me, though, are the growing number of stories in the major press saying how dreadful they are. Apparently drugs firms – the manufacturers of quit-products are funding an anti-e-vape battle – not so much the fag firms (as one might presume) – as they are starting to secretly manufacture them. I can FEEL the benefits of electronic cigarettes. Just FYI – that there is always a hidden agenda with these self interested faceless types trying to censure e cigs … our country’s politicos

I tell everybody I meet to just search on Google for for electronic cigarettes to see for themselves how well established this industry is, and how big the selection is for these life saving products is. Apparently Big Pharma – the manufacturers of stop smoking helpers are backing an anti-e-vape movement – less so the fag firms (as one might suspect), as these are putting money into them. I can now feel all the benefits of electronic cigarettes. Aktuell ist es ja sehr still zu dem Thema geworden. Bin gespannt, ob das Thema nach der politischen Sommerpause nochmal aufkommt.
Wenn es zu einer Beschränkung kommen wird, dann höchstens im Fall des Nikotin. Ich kann mir vorstellen, dass die E-Zigaretten selbst und auch nikotin-freie Liquids weiter frei verkäuflich sind. Die nikotinhaltigen Liquids werden dann entweder von den Apotheken vertrieben oder aber durch den Internet-Grauhandel bedient.
Für den „Dampfer“ sehe ich jedenfalls für die nächsten 5 Jahre kein Problem beim Beschaffen seiner Hardware / Flüssigkeiten.

Dummerweise kann der Verband des eZigarettenhandel aber nichts feststellen, das müssen schon noch Gerichte machen.
Die Tatsache, dass es in Frankfurt oder auch sonstwo im Handel noch E-Ziggaretten gibt, ist jetzt auch nicht besonders aussagekräftig.
Für Verbraucher sehe ich auch keinen Grund, verunsichert zu sein, entweder sie bekommen ihre E-Ziggis oder eben nicht.
Bei Händlern ist meine Einschätzung schon ganz anders. Diskussionen mit dem Zoll führen z.B. meist zu nichts, einen Verweis an einen eingetragenen Verein, der meint, alles ist gut, werden die auch eher mit einem Lächeln quittieren.
